Streaming Channel Owners Terms & Conditions for “Play Radio UK” part of the
Play Radio UK Ltd Group


All orders in whatever terms are accepted subject to the following terms and conditions, which will apply even if we receive an order form with different terms and conditions, unless varied in writing by an authorised representative of Play Radio UK Limited hereinafter referred to as Play Radio UK.

All orders will be written by the customer. A legally binding contract is made only when we accept your written order by sending or otherwise transmitting to you a contract or confirmation of service. After we have sent or otherwise transmitted one of these documents you are not entitled to cancel your order.

The customer shall be deemed to have accepted the service on the date they are notified that it is operational.

The customer agrees with Play Radio UK to pay all charges, VAT and any bank charges that may arise when they fall due.

Play Radio UK warrants to the customer that it will provide all services ordered with reasonable care and skill but Play Radio UK does not warrant or undertake that this will cause the services to operate without fault or interruption.

Play Radio UK can never guarantee a product or service provided by a third party for and on behalf of a customer, however, will endeavour to act in the best interest of the customer.

Play Radio UK shall use all reasonable endeavours to correct as soon as is reasonably practicable any fault notified by the customer.

The customer warrants and undertakes that it shall in its use of the services comply with any relevant legislative and regulatory provisions and shall not use the services for any illegal purpose and shall indemnify Play Radio UK in respect of any liability incurred as a result at a breach of this clause.

Except in the case of emergencies Play Radio UK shall give the customer no less than 2 Business days prior notice of any scheduled service or maintenance or alterations within their network which shall affect the customer. Wherever reasonably possible Play Radio UK shall endeavour to perform these activities in such a way as to minimise any interruption in the provision of service.

Play Radio UK cannot make any guarantees for services provided by third parties outside their network.

Play Radio UK will provide on a monthly basis usage statistics for used bandwidth for every Channel Owner.

Play Radio UK works under the auspices of RIPE allocation of lP address space and may only provide IP address to customers if they adhere to RIPE’s terms and conditions

For customers who are paying annually or quarterly, an additional invoice will be issued every month starting from the first billing date if there is any additional bandwidth or services usage.

In the event of customer hardware failure, the contracted Dedicated or Virtual Private Server is still chargeable but credit allowances will be issued if there is a case.

Should the customer wish to upgrade their server or bandwidth, a new agreement will be drawn.

Downgrading of Dedicated or Virtual Private Servers is only permitted at the end of the contracted period.

In the event of payment not being received by Play Radio UK within 45 days from invoice date, all services will be terminated. Should payment not be received within 60 days, Play Radio UK reserve the right to sell or rent the Channel Server to another customer. Customers will remain liable for outstanding invoice amounts after termination and be charged for the entire contract cost plus fees.

Dedicated and Virtual Private Servers and other hardware remain the property of Play Radio UK throughout the term of the agreement.

Play Radio UK will undertake the installation and configuration of Dedicated Channel Servers and Virtual Private Channel Servers. This is limited to the operating system and other applications if agreed in the Schedule of Services.

In the event of customers requiring additional channel server(s), a new agreement will be drawn; this new agreement will cancel and fully replace any previous contract.

Play Radio UK will not take responsibility for the integrity of data held on backup tapes nor server(s).

The customer shall indemnify Play Radio UK and shall hold Play Radio UK harmless against any and all losses, damages, costs and expenses arising from or in connection with any claims or proceedings brought by third parties against Play Radio UK in respect of or arising directly or indirectly from loss of services.

Any notice required or authorised to be given may be delivered by post to the address stated for that party and shell be deemed to have been served 72 hours after posting.

In the case of any customer who is an individual about whom Play Radio UK processes personal data (as defined by the Data Protection Act), Play Radio UK may use such data to provide the customer with details of other Play Radio UK products, which may be of interest to the customer.

In the event of a dispute between the parties concerning this agreement each of the parties shall in the first instance, bring the dispute at the earliest opportunity to the attention of a Director or similar officer.

All content and software stored or uploaded on the channel servers should be owned or licensed for use or for broadcast and Play Radio UK is not held liable for any content that is stored on a channel server allocated to the customer. 

All contracts are governed by and constructed in accordance with English Law and the parties irrevocably agree to the exclusive jurisdiction of the English courts.

All contract lengths are minimum of 24 months, to cancel this agreement we require
30 days notice and all outstanding months billed at 40% of the contract value paid at the point of cancellation.

Server Service Level Agreement


Dedicated servers

Ensuring that your server is available for the maximum possible time is crucial to our success as a Broadcast Hosting Provider.
Our standard Service Level Agreement (SLA) covers the following points:

  • 100.00% monthly network uptime guarantee
  • 2-hour hardware failure response time
  • Credit allowances for hardware or network failure beyond SLAs
  • 24.7 automated SLA monitoring and notification
  • Ability to provide backup broadcasts in the event of failures

Network guarantee

We offer a 99.99% monthly network uptime guarantee for both Level(3)'s network and our own internal ISP network. In the event of a network fault that takes your server off-line, we will offer a credit allowance.

Hardware guarantee

In the case of a hardware problem with your Dedicated or Virtual Private Server (e.g. failure of hard disk, memory, CPU power supply, etc.) we retain spare machines and parts on site. This enables us to easily change faulty parts or even replace the entire server within 2 hours at no cost to the customer. We will replace failed hardware but we are not liable for the loss of data that results from a hardware failure. We offer a credit allowance for hardware faults extending beyond 2 hours. This hardware guarantee is only available for customers using our hardware.

Monitoring

Our network is continuously and automatically monitored. We are immediately informed of any potential problem so that it is normally rectified before your service is affected. Play Radio UK’s Dedicated and Virtual Private Server customers can apply to have their servers put on the alert system which will page you immediately if any problem with your server is detected.

Solid Security Promise

Play Radio UK’s security systems are first-rate. We have invested considerable time and expertise in ensuring that our security policies, at all levels, are comprehensively monitored and highly-tuned to protect our customers' best interests.
We are compliant with all best practice security procedures regarding data integrity, privacy and the communication of sensitive information.
As an example of this policy we continually reference both the Data Protection Act and British Standard 7799 - Security in Information Systems.

Play Radio UK, Play Radio UK Limited Acceptable Uses Policy


Use the Internet with respect, responsibility and courtesy.   The following are unacceptable uses:

- Illegality of any form, including but not limited to:

  • Unauthorised distribution of copyrighted software and other copyrighted material
  • Unlicensed content or the broadcast of content without permission of the content owner
  • Harassment, fraud, pornographic material (obscene and explicit content), drug (illegal substances) dealing and other illegal activities.

- Net abuse, including but not limited to:

  • spamming (sending unsolicited advertising material to numerous
    e-mail addresses and newsgroups)
  • trolling (posting messages to generate numerous responses)
  • mail-bombing (sending multiple messages with same content to the same user)
  • subscribing other persons without permission
  • cross-posting articles to an excessive number of newsgroups
  • attempting to enter into a secured computer system without authorisation
